A group of concerned citizens has filed a civil lawsuit with the Indiana County Court of Common Pleas against the Indiana County Municipal Emergency Services Authority.
According to court documents provided to Renda Media, the Indiana County Citizens Coalition is suing ICMESA over the group’s founding and the $75 service fee, saying that the actions are in violation of a number of constitutional and legal protections of state law. They claim the people they represent “have been denied their constitutional due process right to object to the imposition of said fee,” and have disregarded relevant provisions of the Pennsylvania Municipal Authorities Act.
In an interview last week on Indiana in the Morning, ICCC representative Cindy Fredrick-Fulton said that the fee on its own would hurt those like the elderly who are on fixed incomes and are unable to pay.
The group seeks refunds for those who have already paid the fees and an order declaring the $75 fee is illegal and unconstitutional.
ICMESA Board Member Jonathan Smith says that they are committed to finding the best solution for all of their participating members.
